August is upon us and the return to school is looming in the future. For the Texas Standard Possession Order that means we get back to our regular schedule.
For weekend possessions this month, the non-custodial parent will get the weekends of the 5th and 19th. Thursdays (or Wednesdays if you have an older order) will begin on the first Thursday following the kids first day at school. If they begin on a Thursday then they begin that evening.
I have had quite a few questions/discussions this summer about weekends during the summer in a standard visitation order in Texas. I have talked about this in the past in a discussion about weekend visitation and summer possession. I do not know how to make it any clearer, but here it goes:
WEEKEND VISITATIONS CONTINUE IN THE SUMMER, THURSDAYS (OR WEDNESDAYS IN THE CASE OF OLD ORDERS) DO NOT. I think that should clear it up. If the child is not on an extended period of summer possession then the weekends (1st, 3rd, and 5th) continue just as they do during the school year. Comprende?

Last year my stepson’s mom didn’t contact us or ask to see him all summer, and when we finally heard from her the weekend before school started, she claimed that she thought she didn’t get any visitation over the summer. I really didn’t buy it, but after reading this, I have to conclude that maybe people do get confused and believe this…

I have extended standard possession and have my kids till they return to school on Mondays during the school year and return them on Sundays during the summer. School starts this coming Monday, the 22nd of August. Do I take them back on Sunday or to school on Monday?

When I designated my summer possession periods I chose two non-consecutive periods, the first beginning June 3rd and ending July 1st, for a total of 28 days, and the 2nd being a 2 week period in August (she moved over 150 miles away).
My ex-wife is claiming that the standard visitation weekend of June 1 counts towards summer possession and that I owe her 2 standard visitation weekends in June. I disagree that this weekend counts and also cannot see how she claims this exceeds the 30 day possession so I do not feel that she can claim 2 weekends in June. Unfortunately she refuses to budge and has threatened to take me back to court. What is the correct interpretation of the rule?
